AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legal agreement between you, whether as an individual or on behalf of an entity ("you"), and Haute Academy, Inc. doing business as PastryClass ("PastryClass," "we," "us," "our," and collectively, the "Parties," or individually, a "Party"), pertaining to your access and use of the website located at the address pastryclass.com, along with any other media forms, channels, mobile websites, or mobile applications related to or connected with it (collectively, the "Website").
Please read these Terms carefully before using this Website. Your use of this Website indicates that you have read and accepted these Terms. If you disagree with any of these Terms of Use, please discontinue using this Website immediately.
We reserve the right, at our sole discretion, to modify these Terms at any time and for any reason. The most current version of our terms of use will be accessible at https://www.pastryclass.com/terms. If changes to our Terms impact how we use your provided data, we will notify you of these changes.
All time references for classes and enrollments are based on the Greenwich Mean Time (GMT) zone.
INTELLECTUAL PROPERTY RIGHTS
Unless explicitly stated otherwise, all intellectual property on the Website is owned by us. This includes materials protected by copyright, trademark, or patent laws (the "Marks"). The Content on the Website, including but not limited to text, design graphics, software code, photos, videos, music, applications, interactive features (collectively, the "Content"), is a collective work under Canadian and other copyright laws and is the intellectual property of PastryClass.
Provided that you are eligible to use the Website, you are granted a limited license to access and use the Website and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Website, the Content and the Marks.
USING THIS WEBSITE AND THE WEBSITE’S SERVICES
USER REGISTRATION
You may need to register with the Website to access and utilize certain Service features. By registering for the Service, you agree to provide accurate, current, and complete information about yourself as prompted by the Service’s registration form. You are responsible for maintaining the accuracy of this information and updating it as necessary. Registration data and certain other information about you are subject to our Privacy Policy. If you are under thirteen (13) years of age, you are not authorized to use the Service, with or without registering. Additionally, if you are under eighteen (18) years old, you can use the Service only with the approval of your parent or guardian.
USER ACCOUNT, PASSWORD AND SECURITY
Your access to this Website must comply with these Terms. You agree to keep your password confidential and bear responsibility for all activities associated with your account and password. This includes passwords for third-party sites if we permit their use to access this Website. Notify us immediately of any unauthorized account use or security breach, and log out of your account at the end of each session when accessing the Service.
MODIFICATIONS TO SERVICE
PastryClass reserves the right to modify or discontinue, temporarily or permanently, the contents, formats or functionality of the Website at any time or for any or no reason at our sole discretion with or without notice. We will not be liable to you or to any third party for any modification, suspension, price change or discontinuance of the Website.
PAYMENTS
You will be required to select a payment plan and provide PastryClass information regarding your credit card or other payment instruments. We may suspend or terminate your account and/or access to our Services and this Website if your payment is late and/or your offered payment method (e.g., credit card or PayPal account) cannot be processed or is declined or revoked. By providing a payment method, you expressly authorize us to charge the applicable fees on said payment method as well as taxes and other charges incurred thereto. Fees for classes are collected by PastryClass from students via Stripe and PayPal services.
We reserve the right to change PastryClass’ payment plans at any time. If applicable, we may give you advance notice of the fee changes. If you don’t agree with the fee changes, you can cancel your account and stop using the Services.
5-STAR FULL REFUND POLICY
At PastryClass, we stand by the quality of our classes and want you to feel confident in your purchase. We offer a full refund if you decide to cancel your paid enrollment within the first five days of your purchase. Upon issuing the refund, your access to the class will be terminated. Please ensure that your refund request is submitted on or before the fifth day from the start of the service to be eligible.
Refund eligibility is limited to one refund per person for the same service within this five-day period. Additional requests for refunds, whether in whole or in part, will not be accepted if made within the same period or for the same service.
Our 5-Star Refund Policy excludes special offers. This includes, but is not limited to, "ALL-BUNDLE" ("ALL-ACCESS") plans, "ENROLL NOW, PAY LATER" installment options, and other discounted or promotional deals. These offers are considered final upon purchase and are not eligible for refunds or cancellation.
Refunds will not be provided for accounts found to be in violation of our Terms of Service. Such determinations are made at the sole discretion of PastryClass. If misuse of the refund policy is identified, we reserve the right to suspend or terminate your account and restrict future use of our services without issuing a refund.

USER SUBMISSIONS
Certain areas of this Website (e.g., PastryClassAI, blog and other functionality) may permit you to submit, post, distribute, upload or broadcast content and materials on the Website, including but not limited to text, video, audio, photographs, graphics, comments, suggestions, personal information or other material or media of any kind (collectively, "Submissions").
When you create or make available any Submissions on the Website, you represent and warrant that:
- You own all rights in your Submissions (including, without limitation, all rights to the reproduction and display of your Submissions) or, alternatively, you have acquired all necessary rights in your Submissions to enable you to grant to us the rights in your Submissions as described in these Terms;
- You have written consent, release, and/or permission of each and every identifiable individual person in your Submissions to use the name or likeness of each and every such identifiable individual person to enable inclusion in your submission.
- Any information contained in your Submissions is not known by you to be false, inaccurate, or misleading.
- Your Submissions do not violate any law (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising).
- Your Submissions do not ridicule, mock, disparage, intimidate, or abuse anyone.
- Your Submissions are not, and may not reasonably be considered to be, defamatory, libelous, hateful, racially, ethnically, religiously, or otherwise biased or offensive, unlawfully threatening, or unlawfully harassing to any individual, partnership, or corporation, vulgar, pornographic, obscene, or invasive of another’s privacy.
- Your Submissions do not contain any offensive comments to any protected class of persons.
- Your Submissions do not incorporate materials from a third-party website, or addresses, email addresses, contact information, or phone numbers (other than your own).
- Your Submissions do not contain any spyware, viruses, worms, adware, or other potentially damaging programs or files.
We do not assert any ownership over your use of the Submissions. You retain full ownership of all of your Submissions and any intellectual property rights or other proprietary rights associated with your Submissions.
By uploading any Submissions you hereby grant to PastryClass, its partners (including but not limited to PastryClass instructors and other third parties providing instructional information through the Services, collectively “Partners”) to:
- Edit, redact or otherwise change any Submissions.
- Pre-screen or delete any Submissions at any time for any reason, without notice.
- Re-categorize any Submissions to place them in more appropriate locations on the site.
- Use your Submissions in any manner and for any purpose (including, without limitation, commercial purposes) that we deem appropriate in our sole discretion (including, without limitation, to incorporate your Submissions or any modification thereto, in whole or in part, into any technology, product, or service).

We may provide you areas on the Website to leave reviews or ratings. When posting a review, you must comply with the following criteria:

INTRODUCTION
These PastryClass Offers are made available by PastryClass. By accepting any of the Offers, you agree to the Terms and that your information will be processed according to the Privacy Policy.
ELIGIBILITY
To be eligible for the Offers, you must be able to provide PastryClass with a valid and current payment method; and complete your purchase and enroll on PastryClass's website directly and not through a third party.
AVAILABILITY
Offers are only available for a limited time. PastryClass reserves the right to modify or terminate these Offers at any time and for any reason. These Offers may not be combined with any other sale, promotion, discount, code, coupon, and/or offer. The Offers are not transferable, exchangeable, refundable, or redeemable for cash, credit, or gift cards, nor are they valid toward previous enrollments or renewals of existing enrollments. Other restrictions may apply.
ENROLL NOW, PAY LATER
For Premium and All-Bundle enrollment plans, PastryClass offers the ENROLL NOW, PAY LATER option, allowing you to spread your payments over 3, 4, or 6 interest-free installments, billed monthly. This option cannot be combined with the GIFT A CLASS offer or other promotions (unless otherwise specified in the offer). Gifts are available only for classes purchased at full price.
HOW TO USE ENROLL NOW, PAY LATER
To use ENROLL NOW, PAY LATER, select this option at checkout and choose to divide your payment into three, four, or six equal installments. Enter your card details to complete your enrollment.
There are no additional fees or interest charges from PastryClass for using a debit or credit card. However, your bank may impose interest or fees if you use an interest-bearing credit card.
CAN I PAY OFF MY BALANCE EARLY?
Yes, you can make an early payment by contacting our PastryClass Care Team at hello@pastryclass.com. If you pay off your balance early, we will stop further charges to your card.
WHICH CARDS DOES PASTRYCLASS ACCEPT?
We accept most major credit and debit cards, but not prepaid cards. We may also not accept cards that are nearing expiration.
WHEN WILL PAYMENTS BE TAKEN?
The first installment will be automatically charged to your card at the time of enrollment. Subsequent payments will be deducted monthly, starting one month after your initial payment. All payments will be processed automatically, so you do not need to manage them manually.
WHAT IF MY CARD DETAILS CHANGE OR MY CARD IS CANCELED?
If your card is canceled or your details change, please update your information by contacting us at hello@pastryclass.com.
WHAT HAPPENS IF A PAYMENT CANNOT BE PROCESSED DUE TO INSUFFICIENT FUNDS?
If we are unable to process a payment due to insufficient funds, we will notify you and make up to two additional attempts to collect the installment. If payment is still unsuccessful, access to your class will be suspended.
CAN I REACTIVATE MY CLASS IF ACCESS IS SUSPENDED?
If you reactivate your account within one month after suspension, you can continue with your existing payment plan. If reactivation occurs after this period, full payment will be required.
